Information on the treatment of personal data

Pursuant to national and European legislation on privacy ( GDPR | General Data Protection Regulation ), we disclose the methods of processing the data processed by our company, in relation to the type of data.

Ownership of the data

bindCommerce s.r.l. is the owner of the personal data relating to potential customers, customers, partners, suppliers, employees, collaborators, and any other person for whom bindCommerce undertakes a direct relationship, with the collection of the personal data of these subjects, submitting to them this information, for the which bindCommerce requires authorization to process.

The collection of the personal data of these subjects can take place through electronic means, such as for example the compilation of the contact forms, or the reception of emails intended for the staff of our company.

bindCommerce s.r.l. does not own the personal data collected through the bindCommerce platform, as it has no direct relationship with the interested parties (customers of our users). For such data bindCommerce is configured as co-responsible for the treatment.

Co-responsibility for data processing

One of the purposes of the bindCommerce service is to integrate heterogeneous IT systems in the post-sale phase, transporting the information relating to orders from the sales platforms (CMS eCommerce, marketplace, etc.) to other systems, such as business management, ERP, logistic systems, etc ...

The architecture of the service provides that these data (personal information of the customers of our users and their online purchases) are stored in our IT systems, and kept there for the time established by the integration processes congenial for our users.

In respect of such personal data, bindCommerce is jointly responsible, although not the owner.

The rights that must be guaranteed to the interested parties (including information before collection, information on the existence, correction, partial or total cancellation - right to be forgotten -, etc.) must be managed by the data controller, who, for the data stored on bindCommerce, can carry out the necessary maintenance actions (such as modification and cancellation) in "self service" mode, through the system interface.

Data Protection Officer

The structure of the Data Controller is equipped with a Data Protection Officer or "DPO".

The DPO is available for any information concerning the processing of personal data of bindCommerce s.r.l., including the list of data processors.

Purpose of the treatment

Your data will be processed for operational and commercial purposes: to respond to your request for information or service, to provide the service itself, and then to update you on the news of bindCommerce.

Disclosure of data to third parties

The data may be processed by some agents appointed by the person responsible for carrying out the service; these persons in charge will be chosen from among the collaborators who perform various functions for bindCommerce: employees, project collaborators, occasional collaborators, external consultants or personnel designated by partner companies to whom specific assignments may be assigned.

Your data may also be disclosed, in your potential interest, to partner companies that manage services that bindCommerce integrates or will integrate in the future, both for technical reasons related to the provision of the service, and to signal commercial opportunities, such as the possibility to sell new products, to place your products on new markets, with new means, or with tools that increase visibility or that foster the relationship with your customers and potential customers.

The communication of your data to partner companies refers only to your contact information (company name, address, Internet sites, contact person, telephone contacts and eMails) and which IT platforms are in use (e.g. CMS eCommerce, management and marketplace). In no case will confidential information relating to your business be transmitted.

Data protection measures

The treatment will be carried out by applying appropriate protection measures, both when these will be processed electronically and when they will be processed by paper means.

Data breach

Our policy provides that any violation of personal data (which accidentally or unlawfully involves the destruction, loss, modification, unauthorized disclosure or access to personal data transmitted, stored or otherwise processed) is communicated to the external controller (user of the service and any partner companies, such as marketplace managers) within 72 hours from the discovery of the violation.

With regard to personal data where the owner is Amazon (data related to orders from Amazon), any violation will be notified to Amazon within 24 hours of discovery and the form and content of the communication to the competent authorities will be agreed with Amazon, in respect of the "Amazon MWS Developer Guide» Data Protection Policy "document.

Duration of treatment

Except when the interested party makes an explicit request for cancellation, the data collected by bindCommerce are kept indefinitely, adopting appropriate safeguard measures for their protection.

With regard to personal data from Amazon, these will be kept only for the time necessary for the purpose of the processing, and in any case no more than 30 days after the shipment of the orders.

Rights of the interested parties

You have the right to obtain confirmation of the existence or not of personal data concerning you. Furthermore, you have the right to be informed: a) of the origin of the personal data; b) the purposes and methods of treatment; c) the logic applied in case of treatment carried out with the aid of electronic instruments; d) the identity of the owner, manager and the designated representative; e) the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them as appointed representative in the State, managers or agents.

Furthermore you have the right to obtain: a) updating, rectification or, when interested, integration of data; b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including data which need not be kept for the purposes for which the data were collected or subsequently processed; c) the certification that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case in which this fulfillment occurs proves impossible or involves the use of means manifestly disproportionate to the protected right.

You have the right to object, in whole or in part: a) for legitimate reasons, to the processing of your personal data, even if pertinent to the purpose of the collection; b) to the processing of personal data concerning you for the purpose of sending advertising materials or direct selling or for carrying out market research or commercial communication.
